General Terms and Conditions

§ 1 Scope and provider

These terms apply to the purchase and use of the software “HMF Address” via this website. The provider and contracting party is HMF-IT UG (haftungsbeschränkt), Parkstr. 31, 49080 Osnabrück, Germany (hereinafter “we”). Conflicting terms of the buyer do not apply.

§ 2 Conclusion of contract

The presentation of the editions on this website is not a binding offer, but an invitation to order. On the “Buy” page, you choose an edition, confirm these Terms, the licence terms and immediate delivery, and click the PayPal button “Buy now”. By approving the payment with PayPal, you make a binding offer. The contract is concluded when we collect the payment and show you the licence key or send it to you by email.

The language of the contract is German. We store the contract text (order data and these Terms in the version applicable at the time). You receive the order data with the order confirmation by email.

§ 3 Prices and payment

All prices are final prices in euros and include statutory VAT. There are no shipping costs. Payment is made via PayPal; depending on what PayPal offers, also by direct debit or credit card. PayPal’s terms of use also apply.

§ 4 Delivery

Delivery is digital: you receive the licence key immediately after payment on the order page and by email, and the software via the download page.

§ 5 Right of withdrawal

Consumers have a right of withdrawal in accordance with the withdrawal policy. For digital content, it expires if you have expressly agreed that we begin delivery before the withdrawal period ends, and you have confirmed that you thereby lose your right of withdrawal.

§ 6 Rights of use

The scope and limits of use (number of PCs per edition, updates, trial version) are governed by our licence terms. They apply in addition to these Terms.

§ 7 Trial version

HMF Address can be downloaded free of charge before purchase and tried for 30 days with up to 25 contacts; printouts then carry the note “Demo version”. After that, viewing, searching and exporting remain possible. There is no entitlement to the provision or further development of the trial option.

§ 8 Updates and support

Buyers receive updates to the extent set out in the licence terms. We provide support by email to hi@hmf-address.de within a reasonable time, usually on working days.

§ 9 Warranty

The statutory provisions on digital products apply (§§ 327 ff. BGB, German Civil Code). Please back up your contacts regularly; HMF Address helps with daily backups and export.

§ 10 Liability

We accept unlimited liability for intent and gross negligence and for injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 11 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state in which they have their habitual residence. Should any provision be invalid, the remainder shall remain valid.
